Processing Application and Assignment Advertisement

Upon processing the application, the assignor is required to publicize the impending transfer as directed by the registrar. This advertisement notifies the public, and a copy is submitted to the Registrar’s office. This step ensures transparency in the transfer ownership of a trademark process. As directed by the Registrar, the applicant is required to publicize the trademark transfer before official registration. The advertisement serves to notify the public, including stakeholders and competitors, about the change in ownership. Submission of a copy of the advertisement, along with a copy of the Registrar’s directive if applicable, is mandatory.

Ownership Transfer

Upon the Registrar’s satisfaction with documentation, legal compliance, and adherence to directives, the official transfer of the trademark from the assignor to the assignee takes place. This comprehensive transfer involves the official registration of the assignee’s name as the new proprietor in the trademark register. The assignee can then use the trademark according to the terms specified in the Trademark Assignment Agreement.

  • TM Registration Certificate
  • TM Assignment Agreement
  • Proof of payment by the assignee
  • No Objection Certificates from both parties, 
  • Board Resolution (if applicable)

  • TM-M application (if registration is pending), 
  • ID and Address Proofs of both parties, 
  • Copy of the Advertisement of the Assignment.
