April 2023:

These were the dates for April 2023: 

Form MSME-1 (MSME Half-Yearly Returns): 30.04.2023

Company registration under the MSME Act, 2006, are required to file Form MSME-1. This form is mandatory for companies with outstanding payments to MSMEs for over 45 days. It’s essential to note that all MSMEs must file a half-yearly return with the Registrar for their outstanding payments to Micro or Small Enterprises. For company annual filing for FY 2022-23, the due date for filing Form MSME-1 for the period from October 2022 to March 2023 is 30th April 2023.

May 2023:

Form PAS-6: 30.05.2023

Unlisted Companies and Deemed Public Companies are required to file Form PAS-6, which is a ‘Reconciliation of Share Capital Audit Report,’ on a half-yearly basis. The Ministry of Corporate Affairs has already prescribed the format for PAS-6. The due date for Form PAS-6 for the half-year ending on 31.03.2023 is 30th May 2023.

June 2023:

Form DPT 3: 30.06.2023

Companies that have taken loans or advances by 31st March of the year must submit Form DPT 3, an Annual Return of Deposits annually. The deadline for filing Form DPT 3 for 2022-23 is 30th June 2023, and it should be submitted within 90 days after the end of the financial year.

July 2023:

FLA Return: 15.07.2023

Each year, companies are required to provide the Foreign Liabilities and Assets Annual Return (FLA Return) to the Reserve Bank of India (RBI). The deadline for submitting the FLA Return for the financial year concluding on March 31, 2023, has been designated as July 15, 2023.

September 2023:

Form DIR 3 KYC: 30.09.2023

Every individual allotted a Director Identification Number (DIN) on or before the end of the financial year, with a ‘Approved’ DIN status, must file Form DIR-3 KYC before 30th September of the immediately next financial year. The due date for Form DIR-3 KYC for company annual filing for FY 2022-23 is 30th September 2023.

October 2023:

Form ADT-1: 14.10.2023

Enterprises are obliged to present Form ADT 1 to the Registrar of Companies (ROC) to formally communicate the selection of auditors, post the culmination of the Annual General Meeting (AGM). The submission timeline for Form ADT 1 encompasses a 15-day window, counting from the AGM’s conclusion, once the auditors’ appointment is officially confirmed. For example, if the AGM is convened on September 30, 2023, the due date for submitting Form ADT 1 would be October 14, 2023.

AOC 4: 29.10.2023

ROC E-Form AOC 4 is used for filing financial statements of the company with the ROC. For AOC 4 XBRL, the due date for company annual filing for FY 2022-23 will be 29th October 2023.

Form MGT 15: 29.10.2023 (Listed Companies)

ROC Form MGT 15 must be filed by all listed companies. It is a form submitted with the ROC for filing the Report of Annual General Meeting. The due date for MGT 15 is 29th October 2023, if the AGM was held on 30.09.2023.

Form MGT 14: 29.10.2023 (If the AGM was held on 30.09.2023 and any resolution was passed therein)

Form MGT 14 is to be submitted with the ROC for filing special resolution/ordinary resolution with MCA regarding Board Report and Annual Accounts. The due date for filing Form MGT 14 is 29th October 2023, if the AGM was held on 30.09.2023. Whenever there is any resolution passed in a board meeting, it becomes mandatory to file such a resolution with the Registrar of Companies in ROC Form MGT 14.

Form MSME-1 (MSMe Half-Yearly Returns): 31.10.2023

Form MSME-1 is required for companies registered under the MSME Act, 2006, with outstanding payments to MSME companies for more than 45 days. All MSMEs need to file a half-yearly return with the Registrar for outstanding payments to Micro or Small Enterprises. The due date for filing Form MSME-1 for FY 2022-23, for the period from April 2023 to September 2023, is 31st October 2023.

November 2023:

These are the dates for November 2023:

Form MGT 7 & MGT 7A: 28.11.2023

Form MGT-7 must be filed with the ROC by all Private Limited Companies and Public Limited Companies registered in India every year. Form MGT-7A must be filed with the ROC by all One Person Companies registered in India every year. The due date for filing MGT-7 is 60 days from the date of the Annual General Meeting. For FY 2022-23, the due date for filing ROC Annual Filing – Form MGT 7 and MGT 7A (considering the AGM date) is 28.11.2023.

Form PAS-6: 29.11.2023 (For the half-year ending on 30.09.2023 – for all unlisted companies, deemed public companies)

Form PAS-6, known as the ‘Reconciliation of Share Capital Audit Report,’ must be submitted twice a year on a half-yearly basis by unlisted public companies. For the half-year ending on 30.09.2023, the due date for Form PAS-6 is 29th November 2023.

Income Tax Return Due Dates for Companies

The due dates for Income Tax Return (ITR) filing for companies in India are as follows:

  • The deadline for filing Income Tax Return (ITR) for companies in India varies based on whether their books of account require auditing. If a company’s books of account do not require auditing, the ITR filing deadline is 31st July 2023.
  • For companies that require their books of account to be audited, the due date for ITR filing is 30th September 2023.
